Back in January 2012, the European Commission set forth its plans for the implementation of data protection restructuring across the European Union with the goal of introducing policy that would prepare Europe for the ‘digital age'. Roughly four years later, an agreement was reached on what that policy would entail, along with a plan for enforcement. The key piece of the reform was introduction of the General Data Protection Regulation (GDPR) which outlined the EU framework for data privacy and protection for organizations in all member-states. This most stringent privacy policy introduced to date would impact businesses and individuals across Europe, and beyond.
What is the GDPR?
As the new European regulation for the protection of the data and privacy of individuals in the European Union (EU), the GDPR is not a directive but a regulation. As such, it does not require any national governments to pass any enabling legislation. The GDPR became directly binding, and enforceable as in May of 2018. Importantly, the GDPR also covers the use and export of personal data outside of the EU in that it addresses to any private data that a company collects pertaining to a European national or corporation. This includes employees, customers, suppliers, and business partners.
